In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.

Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller's future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

P.T.A. TOURS GmbH uses the services of WIRECARD BANK AG ("Wirecard") for payment transactions by credit card

If Wirecard Bank AG ("Wirecard") processes credit card payments from merchant end customers as part of the business relationship with merchants, Wirecard collects, processes and uses the following personal data

of the dealer:

  • Contact information of the dealer

  • Billing details (such as merchant transaction summary overview).

  • Information about the selected payment card as well as payment information of the end customer (e.g., credit card number, status of a payment);
  • Transaction information (e.g., commodity, article number, purchase price, and similar information);
  • Information on the terminal used by the end user (e.g., on the terminal set language);
  • Information about current and past transactions of the end customer, if a credit check is made;

Credit information collected from financial information service providers that provides information about the creditworthiness of the client's end customer (for example, title claims against the end customer).

The purposes of data collection, storage and processing are based on the fulfillment of legal requirements and the contractual relationship with the merchant and the payment of the payment method credit card and the associated assignment of claims. This also constitutes the legal basis for the collection and processing. Since Wirecard itself acts as a payment card acceptance site for credit card companies, it has a particular interest in collecting and processing this data and is thus responsible for the purposes of Art. 4 (7) of the DSGVO.

In this context, Wirecard transmits parts of the end user data to the respective credit card company whose card has been selected by the end customer for payment in order to initiate payment processing. In this case, end-user data can also be transmitted to recipients outside the EU and the EEA, as credit card companies and technical service providers are sometimes not located in the EU or the EEA.
